PRIVACY POLICY

These Terms & Conditions apply to the sale of tickets (“Tickets”) and admission to all events, festivals, tours and experiences promoted and/or operated by Dangerous Goods Entertainment Pty Ltd (ABN 85 649 823 549) (“Dangerous Goods”, “we”, “us”, “Promoter”) held in Australia (“Event”).

The Event will be staged at the area designated by the Promoter within the boundaries of the official event space (“Event Site”).

These Terms & Conditions must be read together with:

Signage at the Event Site
Directions given by Event staff and security

(collectively, the “Terms”).

By purchasing or using a Ticket, entering the Event Site, or otherwise attending the Event, you (“you” or “Patron”) agree to enter into a legally binding agreement with the Promoter on these Terms.

We reserve the right to update these Terms at any time. Updated Terms will be published on our website. If you do not agree, you must not purchase or use a Ticket or attend the Event.

1. CONDITIONS OF ENTRY

You acknowledge and agree:

Dangerous Goods Events are strictly 18+ licensed events (unless otherwise stated).
You must provide valid government-issued photo identification (“Valid ID”) and a valid Ticket (“Valid Ticket”) to gain entry (“Valid Entry”).
Accepted ID includes a valid passport, Australian driver’s licence, or Australian proof of age card.
No pass-outs (exit and re-entry) unless expressly stated.
Entry is subject to capacity and licensing conditions.

We reserve the right to refuse entry or remove any person without refund who:

Does not provide Valid ID or a Valid Ticket;
Is intoxicated, disorderly, aggressive or behaving in a manner that threatens safety;
Is in possession of a Prohibited Item;
Enters an unauthorised area;
Fails to follow directions from security or staff;
Breaches these Terms.

If removed, your wristband will be removed and you will not be permitted to re-enter.

You must comply with all Commonwealth and State laws at all times.

2. TICKETS

Tickets must be:

Purchased through an authorised ticketing provider;
Presented at entry in printed or digital form;
Legible and not defaced (“Valid Ticket”).

Tickets are:

For personal use only;
Valid for one person only;
Non-transferable unless permitted by the ticketing provider.

You must not, without written consent:

Resell a Ticket for more than the original purchase price;
Use Tickets for advertising, promotional or commercial purposes;
Use Tickets to enhance demand for other goods or services.

Lost, stolen or damaged Tickets will not be replaced.

All prices are in Australian Dollars and may include booking fees and GST.

Errors made during purchase or changes in personal circumstances do not entitle you to a refund.

Purchase limits may apply and we reserve the right to cancel excess orders.

3. PROGRAMMING CHANGES, CANCELLATION & REFUNDS

The Promoter reserves the right to change any aspect of the Event including:

Artist line-up
Performance times
Venue
Date
Stages
Site layout
Capacity
Amenities
Event schedule

(collectively, “Event Details”).

Changes to Event Details do not entitle you to a refund.

If the Event is postponed, Tickets will be valid for the new date. If you cannot attend the new date, refunds may be offered in accordance with Australian Consumer Law and ticketing provider policies.

Force Majeure

We may cancel, postpone or alter the Event due to circumstances beyond our control (“Force Majeure Event”), including but not limited to:

Severe weather
Natural disasters
Fire or flood
Government directions
Public health emergencies
Artist cancellations
Industrial disputes
Security threats

If cancelled due to Force Majeure, refunds (if offered) will be limited to the face value of the Ticket only and exclude booking or processing fees unless required by law.

We are not liable for travel, accommodation or other expenses incurred.

4. WRISTBANDS

A wristband will be issued upon Valid Entry.

Wristbands:

Must be worn at all times;
Must not be removed, shared, tampered with or altered;
Remain the property of the Promoter.

Anyone not wearing a valid wristband may be removed without refund.

5. SEARCHES

All Patrons may be subject to search upon entry and during the Event.

Security may:

Conduct pat-downs;
Inspect bags;
Use metal detection devices.

Refusal to consent to a search will result in refusal of entry or removal without refund.

6. PROHIBITED ITEMS

The following items are strictly prohibited:

Illegal drugs or illicit substances;
Weapons or items capable of causing harm;
Glass of any kind;
Alcohol (this is a licensed event);
Open flames, flares, fireworks, sparklers;
Professional audio or video recording equipment (unless authorised);
Drones;
Promotional materials (flyers, stickers, posters);
Sound systems;
Laser devices;
Selfie sticks;
Skateboards, scooters or motorised vehicles;
Any item deemed dangerous by the Promoter.

Patrons found with Prohibited Items may be refused entry or removed without refund and may be referred to authorities.

Dangerous Goods does not condone illegal drug use. Any Patron found in possession of illegal substances may be reported to police.

7. PATRON BEHAVIOUR

You agree to:

Follow directions of staff and security;
Behave respectfully toward others;
Not engage in violence, harassment or dangerous conduct;
Not stage dive, crowd surf or engage in unsafe activity;
Not damage property or the environment;
Wear appropriate clothing and footwear.

Failure to comply may result in removal without refund.

8. SAFETY & ASSUMPTION OF RISK

Entry is at your own risk.

You acknowledge that Events may involve:

Loud music and strobe lighting;
Large crowds;
Physical contact with other patrons;
Weather exposure;
Uneven surfaces;
Temporary structures.

You voluntarily assume all risks associated with attendance.

To the fullest extent permitted by law, you waive any claims for loss or injury not caused by our negligence.

9. POLICE & AUTHORITIES

Police and authorised officers may attend the Event and exercise their legal powers.

You must comply with lawful directions from authorities.

10. MEDICAL

We may arrange emergency medical assistance where reasonably necessary.

By attending, you consent to:

Receiving emergency medical treatment;
Sharing relevant personal information with medical providers where necessary.

11. EMERGENCY PROCEDURES

In an emergency you must:

Follow directions from staff, security and emergency services;
Evacuate when directed;
Not obstruct emergency access areas.

We reserve the right to interrupt or stop the Event for safety reasons.

12. LIABILITY

To the maximum extent permitted by law:

The Promoter is not responsible for loss, theft or damage to personal property.
We are not liable for indirect or consequential loss.
We are not liable for travel or accommodation expenses.

Nothing excludes rights under the Australian Consumer Law.

You indemnify the Promoter against claims arising from your breach of these Terms.

13. PHOTOGRAPHY & FILMING

Professional recording equipment is prohibited unless authorised.

By attending, you:

Consent to being photographed, filmed or recorded;
Grant Dangerous Goods a perpetual, worldwide, royalty-free licence to use your image and likeness for promotional purposes;
Waive any right to approve final content.

Unauthorised recordings may be confiscated and copyright in such recordings assigned to the Promoter.

14. PROMOTIONAL MATERIAL

You must not distribute third-party promotional material within or near the Event Site without written permission.

15. INTELLECTUAL PROPERTY

All Dangerous Goods logos, branding, artwork, visuals and event materials are owned by the Promoter.

You must not use Event intellectual property for commercial purposes without prior written consent.

16. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia.

You submit to the exclusive jurisdiction of the courts of Victoria.

If any provision is unenforceable, the remaining provisions remain valid.

The Promoter may assign or novate its rights and obligations to a related entity or third-party operator.
